Kasungu First Grade Magistrate Court has sentenced Joseph Adam, 76, to six years Imprisonment with Hard Labour (IHL) for defiling a 12 year old girl.The court heard that Adam, who was working as a watchman at Kasungu LEA Primary School on February 26, 2018 committed the offence in his own house where he managed to trap the victim who is in standard 3 at the same school.
The suspect is said to have requested the victim to draw water for him and when she had returned with the pail of water, Adam told her to leave it inside his house but as the victim entered the house to drop the pail of water, Adam followed her and eventually defiled her. Police arrested Adam after a tip from one of the girl’s teacher.
According to Kasungu Police Deputy Public Relations Officer (PRO), Harry Namwaza, after Adam had defiled the girl he gave her porridge flour to shut her mouth.“The victim revealed the ordeal after one of the teachers asked the victim where she had got the porridge flour since it is not distributed to learners. The teacher reported the matter to police who arrested Adam and charged him with defilement which is contrary to Section 138(1) of the Penal Code,” said Namwaza.
In court, Adam pleaded guilty to the charge of defilement and in mitigation he begged for leniency, saying he was old and has more children to take care of.However, State prosecutor Inspector Griffin Luhanga requested the court to give Adam a stiff punishment to teach him a lesson and other would-be offenders.
Luhanga argued that Adam ought to behave responsibly considering his age and that such kind of behaviour was totally a menace to the society which ought to be stopped. Kasungu First Grade Magistrate, Damiano Banda, concurred with Luhanga and described Adam’s behaviour as totally immoral.
Banda quashed Adam’s claims to consider him for a lenient sentence due to his old age, arguing at his age if he was a responsible old man he should not have committed such an offence.Banda then sentenced Adam to six years imprisonment with hard labour. Adam comes from Chilipadambo Village, Traditional Authority Kaomba in the district.
