Compensate Brian Banda K103 Million For Unfair Dismissal – State House Ordered

0

By Burnett Munthali

In a latest ruling by the Industrial Relations Court (IRC) on December 23rd, Deputy Chairperson Mike Kandulu mandated that State House must pay former President Lazarus Chakwera’s spokesperson Brian Banda K103,316,418 for unfair termination of employment.

Additionally, the Times Television presenter has been granted a severance allowance of K1,251,418.50.

First of all, in all fairness, I would like to congratulate Brian Banda for taking this matter to court and finally winning the case. I would have complained if Brian dropped this matter without fighting against the injustice because I knew this was wrong right from the beginning. However, the Times radio presenter went to court quietly without making any noise about it and it was as if there was nothing happening in the ground until just now because I never saw it anywhere in the media.

Brian Banda

Secondly, I have liked how smart Brian has handled himself throughout this matter. He would have chosen to say something on times radio when Mwayi za ndebvu sorry, ndebvu za Mwayi, Wonder Msiska first welcomed him back from State House or even on his Facebook page but he didn’t. I remember, there were so many thought provoking questions which Wonder Msiska asked Brian to clarify but he smartly answered and dodged mentioning that he was going to take or had already taken legal action against State House. To that point, he has proven to be very smart indeed and there’s no doubt about that.

Thirdly, Brian Banda is courageous. He has just shown and demonstrated that courage by going to seek legal redress from the court. Many people would leave injustices done to them unresolved by not taking the matter anywhere. It takes only courageous people to wage a legal battle like this one and I see great courage in this man.

Fourthly, the radio and TV presenter is a journalist and not a lawyer but he knew that he was unfairly dismissed from his job so he went to court and sued the State House. That demonstrates to me he is knowledgeable about the labour laws of this country and his rights. People must know their employment service regulations anywhere they go to work if they don’t, they must ask around for legal opinion because only knowledge is power.

Finally, State House could have avoided all this embarrassment of firing Brian Banda at the time which has backfired today. The President should have saved these millions of Kwacha government is compensating Brian today for something else because he made himself a champion of rule of law in his Hi-5 but this is abuse of law by State House and not rule of law. Infact tax payers are going to pay double the price for this administrative error because while government is compensating Brian Banda for unlawful dismissal, there’s someone else who is being paid for the same job at State House in place of Brian Banda. This could have been avoided.

And again, The Attorney General must have failed his job of advising President Reverend Lazarus Chakwera of the legal implications on this matter. Probably, he simply avoided advising the President in order to save his job because he might have seen how Attorney General Silungwe, who had strictly advised the President got fired. Silungwe was a very strict Attorney General and could not bow down to lawlessness which he didn’t want to be part of.

On the other hand, if the Attorney General did his job, then President Reverend Lazarus Chakwera must have refused to listen to his legal advisor, the Attorney General, in the likeliness of losing this unlawful dismissal case. I think our president must be a very arrogant President who would like to disrespect the same laws which he ignorantly would like to defend.

Chimwemwe Phiri takes automation training to capital city

After successfully facilitating automotion training in Blantyre in December 2023,Chimwemwe Phiri, a Managing Director at Tichi Automation says he will now facilitate the similar training in Lilongwe from 8 to 10 January, 2024.

In an interview with 247 Malawi News, Phiri said the training in Lilongwe will take place at Shareworld University.

He said the training helps students for the industrial world.

Phiri indicated that at a time robotics and automation are becoming the in-thing,the training also helps the students get jobs as they gain hands-on experience, knowledge and skills.

“This training will be hands-on. It will involve wiring up and programming. The key focus is on programmable logic controllers. But we will have an introduction on the human machine interface [Connecting people and machines in line with current trends]. We will also look up variable speed drives, pneumatics and industrial sensors,” said Phiri.

According to him, programmable logic controllers are the main head of the industrial revolution youngsters have an affinity to, with industrialization as one of the key pillars in the attainment of the Malawi 2063.

He said the time is opportune for interested people to programme and operate an industrial-related computer system that continuously monitor input devices which make decisions based on customised programmes.

Phiri said upon the completion of the training, the students will be able to identify Programmable Logic Controllers (PLC) inputs and outputs, Troubleshoot programs and perform visual inspections, create sequences and programmes, perform online uploads and downloads, and develop industrial projects.

He said the attendance fee for the training per participant is still K60, 000 as it was in the commercial city.

Chimwemwe Phiri did his technical studies in Malawi and worked with Malawian companies before going to South Africa to work with a Denish tech company where he has been working as an automation technician.

While working with the company, he has also been undergoing different courses to do with technical and engineering studies.

In March last year, Phiri created a pick and place robot as a contribution towards Industrial automation.

The robot can be used in automated warehouses and factories for carrying things from one point to another.

FCB Nyasa Big Bullets claimed a historic quadruple trophy haul on Saturday at Kamuzu Stadium in Blantyre, after beating Mafco FC 2-1 to win Airtel Top 8 Cup, Season 6.

Lanjesi Nkhoma was the hero of the day after claiming a brace to seal yet another title for the People’s team who had already won Super League title, FDH Cup and Castel Challenge Cup.

The People’s team got their first chance in the game just 6 minutes from kick off when Maxwell Phodo headed over the cross bar from a rebound after Mafco goalkeeper Christopher Mikuwa fumbled a Patrick Mwaungulu’s free-kick.

Mafco almost took the lead in the 10th minute when Mphatso Phillimon was found unmarked in the six yard box but his header went over the cross bar.

Prince Kachere who equalized for Mafco during a semi-final clash against Silver Strikers, missed a golden opportunity when he was found unmarked in the six yard box, only to shoot wide when the goalkeeper was already beaten.

Nkhoma broke the deadlock in the 22nd minute as he scored with a simple tap in after he was found unmarked following an Anthony Nfune’s brilliant cross.

The Salima-based soldiers equalised in the 34th minute through an own goal by Nickson Nyasulu who connected into his own goal, a well taken free-kick by Aubrey Chafewa following a communication breakdown between himself (Nyasulu), Clyde Senaji and goalkeeper Clever Mkungula.

In the second half, Mafco got their first chance in the 46th minute through Philmon but just just like Kachere in the first half, he fired wide from a close range.

Bullets had a chance to reclaim the lead in the 50th minute through Patrick Mwaungulu but his shot was again beautifully saved by Mikuwa.

In the 70th minute, Bullets were awarded a penalty by referee Mayamiko Kanjere after Chafewa fouled Phodo in the penalty box.

The own goal scorer, Nyasulu stepped in to take the penalty, perhaps to have his sins forgiven, but unfortunately it didn’t go as planned.

Mikuwa saved Nyasulu’s penalty but the defender has Lanjesi Nkhoma to thank as he scored from a rebound to put his side back in the lead.

Despite the goal, Mafco continued to play with confidence and they almost got an equalizer in the added time but Peter Kasonga’s header went wide.

After the match, Nkhoma was voted man of the match but that was not the only thing that he achieved as he has also finished the tournament as the Top Goal Scorer having netted three goals.

In a related development, Bullets defender Yamikani Fodya has announced his retirement from active football after playing for the club for 14 years.
