Ben Longwe accuses Mec of not consulting Malawians

A human rights activist based in South Africa Sir Charles Ben Longwe, has accused Malawi Electoral Commission (Mec) of doing things as if there is no Malawians assuring it that Malawians will not listen to its electoral calendar that elections be held in September, 2025.

Longwe has observed that the Electoral body is favouring President Dr. Lazarus McCarthy Chakwera disregarding the wishes of Malawians that are very conversant with the Constitution that elections shall be held every after 5 years.
He has made it clear that Mec is not above the law inviting patriotic Malawians and those that wants justice to stand with Ben Longwe and Redson Munlo to fight so hard until Mec bows down to Malawian pressure to hold elections on 21st May, 2024.

Mec didn’t consult the citizens on electoral calendar to September, 2025 elections-Ben Longwe

Speaking through an audio clip circulating in various social media platforms, Ben Longwe has made it clear that September, 2025 elections is for Mec while Malawians will hold theirs on 21st May, 2024 in line with the demand of the constitution.

Longwe said if the Mec continues to preach about the 2025 elections, Malawians will go to the constitutional court judges to tell them on what the judgement said assuring Mec that Malawians of today are very different with those of 2020.
He has appealed to Mec to learn to consult the citizens not politicians if it wants to win trust of the people saying one man cannot influence the electoral calendar to change to suit his wishes, Malawians are ready to fight for justice to prevail.

The activist said time for Malawians to stay quiet have gone, this is the time to stand up observing with sadness that the MCP is playing around with the constitution claiming that it has killed the opposition DPP while UDF was at the verge of dying a natural death.
“Those who wants justice, be with Ben Longwe and Redson Munlo, we will not reach 2025 for one person, justice must be seen,” said Ben Longwe.

He has announced that from next week Wednesday, Thursday and Friday the Human Rights Ambassadors (HRAs) will lead Malawians in holding National Prayers to pray for God’s mercy over Malawi that MCP has brought untold pain and suffering in Malawians.
Longwe said the 3 -day vigil will be held at the offices of District Commissioners across the country to stand in solidarity with Palestinians that are being killed in Gaza fighting for own state and Malawi Electoral Commission vs Malawi First in defense of the constitution for elections to be held on 21st May, 2024.

Jumah claims treason ended in 1994 in Malawi

President of Muvi wa Chilungamo Revolutionary Party (MRP) Bantu Saunders Jumah, says Treason was done in the Malawi Congress Party (MCP) government of the late Ngwazi Dr. Hastings Kamuzu Banda that all against him were regarded as enemies of the country.

Jumah said it is sad that after Malawi attained multiparty democracy in 1994, some people have found a way of intimidating others that holding demonstrations against the sitting President, warrant to Treason charges in Malawi.
He has since appealed to District Commissioners not to use treason in their letters to activists as they are notifying them on the planned demonstrations against the sitting president who is working contrary to the wishes of the voters.

Holding demonstration is a constitutional right-Jumah

Speaking through his face book to millions of Africans commenting on the letter wrote by District Commissioner for Lilongwe Dr. Lawford Palani to Malawi First stopping them from holding street protests to Kamuzu Palace in Lilongwe to deliver a petition to President Chakwera, Jumah has reminded all that holding demonstrations are provided for in the constitution of the Republic.

In the letter, Dr. Palani said it is treason for Malawi First to go and march towards the State House describing this as “Treason” arguing that probably the DC does not know the Constitution or has chosen to ignore the contents of the Republican Constitution.
Jumah said there is no offence for marchers to go towards the State House to present their petition saying the law allows the marchers to stand at 100 meters away from the State House claiming that activists and protesters were all aware of this law.

He has asked Dr. Palani to explain to Malawians where is the treason case committed by activists and protesters set to go towards the State House describing him as a treasonous public officer breaching the Republican Constitution.
The MRP President says Malawi First was not wrong to present a petition to President Chakwera at the State House reminding Malawians that Dr. Chakwera told Malawians that if he fails to govern the country in 2 years, he will resign.

He said President Chakwera is now in his 3-year term office, Malawians have lost trust in him as their leader, he is failing to listen to the cries of the citizens, a petition has to be delivered to him to address the issues at hand.
“We are deploring the letter written by District Commissioner Dr. Lawford Palani, we are not in support of the demonstrations or against the demonstrations but the letter itself “Treason, the DC offended the Constitution,” said Jumah.
Jumah has finally appealed to all District Commissioners across the country not to abuse their powers reminding them that Malawi is in democracy where there is freedom of speech, association, opinion and the right to present grievances to the Head of State as their employee.

No one is above the law, Chisale must shut up his big mouth

On Monday former bodyguard to the recent past Malawi President Peter Mutharika went on air on Zodiak Exclusive program.

By the look of things Norman Paulos Chisale had well planned to go flat out to castigate Government officials calling them names.

Chisale used words like “Chiminister” which was even not allowed in broadcasting as well as words like “bullshit”.

Chisale is supposed to know that he is not above the law. Being the former bodyguard and military officer does not warrant him to think that he is beyond laws of Malawi.

The Malawi Constitution and the Penal Code has no face and the do not look at who is who. Chisale should be aware that he is under investigation and no one is supposed to go to the media until all cases are done.

Contempt of court.
Lets get into details in examining if Chisale is committing court contempt or not and its consequences.

Contempt of court, also referred to simply as “contempt” is the disobedience of an order of a court. Additionally, conduct tending to obstruct or interfere with the orderly administration of justice also qualifies as contempt of court.

Civil Procedure and Evidence Rules says that a party that fails to perform a specific act, in accordance with a judgment by a court, can be charged with contempt and subsequently penalized.

The purpose of recognizing contempt of court is to secure the dignity of the courts and the uninterrupted and unimpeded administration of justice.

According to the law literatures punishments for contempt include imprisonment and fines. However, according to the Supreme Court, civil contempt penalties are conditional. One who is punished for civil contempt can avoid the punishment by doing as the court ordered and is therefore described as “carrying the keys of their prison in their own pocket.”

This is the best time Chisale should be aware of all this by remaining within the rearm of the law since no one is above the law.

The country’s financial institutions regulator, Reserve Bank of Malawi(RBM), says it is impressed with the strides that have so far been recorded from the pension funds contributions in the country.

Director of administration and services for the country’s central bank, Lanjesi Sinoya disclosed this in Blantyre during life insurance and pension funds seminar organised by Lifeco holdings limited.

Sinoya said since the pension Act was initiated in 2011,the pension funds contributions have reached a total of MK2.4 trillion as of September 2023.

“This is very impressive indeed and huge growth as compared to the MK74 billion pension funds contributions the country recorded in 2011 when we started regulating the funds,” he said.

Sinoya said the central bank was more excited about how the pension sector was resilient in servicing the funds.

“However, there is still a huge task to do inorder to woo more players to contribute to the funds. Many employees and employers are still in the dark on the benefits of contributing to the funds. For example, only a total of 542 employers the whole country have contributed to the 2.4 trillion out of many employees that the country have,” he said.

According to him, the country has so far invested in huge power and energy sector, transport, construction and water sectors using the proceeds from the pension funds.

In a separate interview, board chairman for Lifeco holdings limited, Lyton Chithambo, said his insurance company organised the seminar to equip its clients on the clauses of the revised pension Act of 2023.

“This will surely go towards improving compliance levels as the clients will be able to make a decision based on the right information shared,” said Chithambo.

Lifeco holdings limited started its operations in the country in 2020.

The insurance holdings company has Lifeco Asset management company, Lifeco pensions services company and Lifeco insurance company under its roof.

Govt rebuffs China Railways over K28 billion claim

Minister of Transport and Public Works Jacob Hara over the weekend put his foot down not to pay an additional K28 billion which the contractor working on the Nsanje-Marka Railway Line was demanding.

The decision was against what , China Railway 20th Bureau Group wrote to the ministry asking for additional funds for the project, initially pegged at K68.2 billion.

The contractor argued that the ministry had come up with extra works for the project, hence the increase in cost.

But in an interview on Times Exclusive, which aired on Times Television on Saturday, Hara said government has rejected the proposal “for now”.

“We indeed received the proposal and we acknowledged that the contractor was justified to ask for the increase. However when I received the proposal, I considered a number of things including procurement law, which demands that we go through PPDA [Public Procurement and Disposal of Assets Authority] which might take some time. So we have decided not to give them [the money],” Hara said.

He added that the contractor has been informed to do what they can manage with the money that was allocated for the project.

Recently Parliamentary Committee on Transport and Public Works members visited the project site, the contractor alleged that the ministry proposed several additional things which led to the increase in total cost.

The contractor said upon seeing what was in Mozambique, the ministry proposed the installation of five loop lines. The initial plan was to have two loop lines but the ministry proposed [that we] mirror what is in Mozambique because it will help in saving on operation costs.

The contractor further indicated that the increase was necessitated by floods that hit the Southern Region district, which resulted in adjustments in the design.

The Malawi Government is funding construction of the 72-kilometre railway line from Bangula to Marka.
