Malawi Government on Monday February 12,2023 moved on to withdraw its appeal against the High Court ruling over the interdiction of Anti-Corruption Bureau (ACB) Director General Martha Chizuma

Chancy Gondwe, one of the private-practice lawyers appointed by the Attorney General (AG) Thabo Chakaka Nyirend told local media in an interview that they initially went for an adjournment, but Justice John Katsala declined on grounds that the interdiction of Chizuma being the basis of the matter was lifted.

He said the court admitted that the issue was stale and there was no need to continue wasting court’s resources on that.

Gondwe went on to say that the government side later applied for withdrawal of the matter and lawyers representing Malawi Law Society (MLS), Patrick Mpaka and Chrispin Ngunde, did not object.

“The court proceeded and withdrew the case,” said Gondwe.

After the withdrawal, MLS asked the court to award them costs of the case but he (Gondwe) objected to arguing that lawyers on both sides, MLS and government, were acting pro bono (for free).

He said the court agreed with him, and declined to make any order on costs.

On his part, Lawyer Mpaka said in an interview that what the withdrawal meant that there is no case in the Supreme Court where the State wanted to appeal after its application for the “urgent application” was rejected by High Court judge Mike Tembo.

Chizuma was facing an imminent arrest for defamation over her leaked audio.

In the audio, the ACB Director General alleged that a member of the Judiciary and several lawyers had received bribes to release on bail a suspect.

She also made serious allegations against President Lazarus Chakwera who she claimed was not supporting her fight against corruption.

Her allegations drew the ire of the President who claimed to come close and chop her head.

In a broadcasted message, Chakwera revealed that he had put the Chizuma up for disciplinary hearing to decide her fate.

But in the process of the case hearing, the newly appointed Director of Public Prosecutions (DPP) Masauko Chamkakala announced that his office had made a decision to withdraw all criminal defamation charges Chizuma was facing which were laid before Lilongwe Chief Resident Magistrate Court.

The Malawi High Court sitting in the capital city Lilongwe on Monday ordered South African witnesses in the Prophet Shepherd Bushiri’s extradition case to physically come to Malawi and testify before the Chief Resident Magistrates Court.

The ruling follows an appeal the Bushiris made against an earlier ruling by the magistrate court that witnesses should testify in South Africa.

“The witnesses to the extradition hearing will testify physically in the presence of the Chief Resident Magistrate here in Malawi on a date and time to be appointed by the court,” reads the ruling by Judge Bruno Kalemba.

Bushiri and Wife

Commenting on the issue, Bushiri’s lawyer Wapona Kita welcomed the ruling saying the court has granted their prayer for the witnesses to come to Malawi and testify physically.

Bushiri had alleged that there have been assasination attempts after the two opened cases against some individuals in South Africa.

On his controversial return to Malawi, Bushiri said he was being maltreated by systems in South Africa.

He has since described the ruling as fair and that he looks forward to meeting the witnesses in court where they will exercise their right to cross examine them for a fair ruling .

The Malawi’s popular Prophet and together with his wife Mary Bushiri who are constructing Goshen City in Malawi face fraud and money laundering charges in South Africa.

They fled the Rainbow Nation in 2020 after they were given bail.

MUBAS student Ketson Kayuni writes a motivation book’ Life Purpose

By Chisomo Phiri

A 20-year-old student studying Internal Auditing at Malawi Univerdity of Business and Applied Science (MUBAS) Ketson Kayuni has published a book titled’ Life Purpose’.

Speaking in a separate interview, Kayuni who is in third year of his studies at the university, said among other topics, his book contains knowledge on how people can discover themselves and use their mind to achieve life goals.

He explained that the motivational book also contains clues on how to overcome fears.

Ketson Kayuni

The student disclosed that it took him two years to finish writing the book which he has helped him to put more knowledge in the publication.

According to Kayuni, the book was written under inspiration of various realities of life which in most cases make people to fail achieving their set goals.

“Just want to let people know that a life with a purpose is worth risking because you know what you are doing and the benefits after that. You lose less”, he explained.

Adding “The other thing that inspired me most to write this book is that we all have a chance or option to choose who we want to become, but small things make us fail to reach our goal like “not knowing what to do” and “fear”.

“Lastly, just wanted to let people know that a life with a purpose is worth risking cuz you know what you’re doing and the benefits after that. You lose less.”

The young author who is also the founder of a fast growing brand Survivor 01 urged people to read his book so as for them to gain new much needed knowledge for success.

Said Kayuni ” I would recommend people to buy and read this book not only because they will learn a lot but they will also appreciate that in Malawi we can also write and produce good materials.

“It’s my pre to the industry that they should support the Malawian talents.

“It’s high time we start reading our products/ books than always spending money on amazon and other means of buying books. we lose a lot from that. Let the talent pay the talented.”

Commenting on how he looks at writing industry in Malawi, the young author who is inspired by MERA CEO and the country’s renowned motivational speaker Henry Kachaje said despite writing industry not doing well in Malawi, it does not mean there is no promising future.

” I have noted one problem. The youth are not supported and the government does not recognise the talents the youths have. Writing is underestimated in our country and yet our friends are benefiting from such. It is so pathetic that even the literature we learn is from outside and yet we can learn from locally made books. The government should try trusting and supporting the youths in recognising their talents,” he said.

To his fellow authors, especially those who want to start writing,Kayuni encouraged them to always believe in themselves that they can do it.

“Know what you’re doing. you will receive discouragement even from those you thought they will support you, that’s part of the game. Writing is not easy, and it’s easy if you take it rightly.

“Never give up on what you’re writing. It might not be that book or piece of writing that will put you at a position of your interest, but the next one will always do. Don’t stop on the way,” he encouraged.

After reading part of Kayuni’s book, author kiran Ntapasha appreciated how it has been compacted

” I will always turn to this book to remind myself that a life with purpose is worth risking, building and living. There’s wisdom in the pages of this book.”
