Should the courts run the affairs of political parties in Malawi?

It is widely believed that the courts are the final arbitrators of justice between the aggrieved parties in our society.

Assumptions are also always held among members of the general public that they can get fair and just verdict from our judicial system.

Unfortunately, the truth is that as human beings, magistrates, judges and justices in our court system are prone to bias and error too. They are literally not infallible.

This is why most verdicts delivered in the lower courts are appealable to a higher court. Even at the Supreme Court of appeal, the finality of their verdicts does not imply their infallibility.

What has caught my profound curiosity is the way the courts have been running the affairs of the main opposition party, the Democratic Progressive Party (DPP).

Full of Court battles-DPP



It seems like our judicial system is so much privileged that it is on the driving seat of DPP machinery.

Firstly, the Constitutional court hereinafter referred to as Concourt, annulled 2019 presidential elections which Prof. Arthur Peter Mutharika (APM) won, although there was no evidence of rigging. Even international observers had endorsed such elections as being free and fair.

It is pathetic that Concourt’s verdict was only based on mere presence of electoral irregularities which were not proved to have affected any presidential candidate’s votes.

Secondly, the Concourt goofed by faulting the victor of 2019 presidential elections that he did not meet the 50%+1 majority when all previous presidents were elected based on a simple past-the-post strategy as endorsed previously by the Supreme Court of Appeal.

Obviously, the 50%+1 Concourt’s interpretation of the Constitutional term ‘majority’ could not have been applied retrospectively.

Thirdly, the Supreme Court of Appeal sustained the Concourt’s verdict even though it was aware that it had made serious legal errors such as a fallacious argumentum ad dictionarium on the interpretation of the term ‘majority’ and nullifying legitimate presidential elections where there was no evidence that electoral irregularities had affected the candidates’ votes.

Fourthly, the court granted an injunction to sustain Kondwani Nankhumwa as the Leader of Opposition in Parliament although there were irregularities in his appointment as there was ample evidence that the Speaker of the National Assembly, Mrs. Catherine Gotani Hara, was directly and single-handedly involved in handpicking Kondwani Nankhumwa.

Fifthly, it was unfathomable and illogical when the High Court ruled that an inquorate panel of Malawi Electoral Commissioners (MEC) did not affect the legitimacy of 2020 fresh presidential elections.

The truth of the matter is that MEC that presided over the 2020 fresh presidential elections did not form a quorum, if Judge Kenyatta Nyirenda’s illogical judgment is to go by. Therefore, the formulation of MEC commissioners then was supposed to be rendered unconstitutional.

For sure, unconstitutional MEC had no constitutional mandate to determine the winner of 2020 fresh presidential elections.

A rerun of 2020 presidential elections could have been a fair and just verdict.

Unfortunately, the Supreme Court of Appeal again sustained the High court’s verdict that the 2020 fresh presidential elections could not be nullified.

Sixthly, there is an attempt by the court to resolve the DPP internal squabbles by providing legal solutions. However, political wrangles require political solutions.

Ironically, the same court goofed by providing political solutions to a legal electoral quagmire by nullifying 2019 presidential elections when it admitted that it did not find evidence that electoral irregularities had affected the candidates’ votes. It looks like our judicial system is a scam.

It is not true that internal squabbles in DPP can only be addressed by litigation. There are other avenues of resolving conflicts.

Thomas-Kilmann model, identifies five different approaches to conflict resolution vis a vis avoiding, competing, accommodating, collaborating and compromising.

It is my hope that the DPP leadership and its members can consider these five conflict resolution approaches before taking their disagreements to court.

The DPP as a party must accept that there is a conflict of power struggle between Kondwani Nankhumwa and Prof. Arthur Peter Mutharika. It must not ignore this quandary.

Perhaps, the two presidential aspirants they tried to avoid each other for a long time but then they discovered that it didn’t work out.

As it is on the ground, Kondwani Nankhumwa is directly competing head-on with APM. They are both using a win-lose strategy as means of conflict resolution management.

Kondwani’s strength is the favour he gets from our courts while APM’S privilege is the DPP constitution and moral support from some sect of the party.

In my view, the DPP must go further to implement accommodating, collaborative and compromising conflict resolution strategies.

Accommodating conflict resolution technique demands that one party to the conflict must be prepared to lose for the sake of maintaining cordial relationships. That is why it is called a win-lose strategy.

In this case, I implore Kondwani Nankhumwa, as an upcoming, youthful and vibrant political figure to pave way for his incumbent party president, Prof. Arthur Peter Mutharika.

Another suggested pragmatic approach to the conundrum rocking DPP is the collaborating strategy also known as a win-win strategy.

In this scenario, both Peter Mutharika and Kondwani Nankhumwa can sit on a round table to discuss all the possibilities till both contesting parties accept a mutually agreed solution.

Lastly, both Kondwani and Peter must be prepared to lose their egos. This is called a lose-lose strategy or a compromising conflict resolution technique.

For example, both Kondwani and Peter can forgo their presidential ambitions paving way for other aspirants to compete amongst themselves.

In conclusion, this article has delved into various ways in which the leadership of DPP can initiate dialogue with aggrieved parties by bypassing avoiding and competing conflict resolution approaches while employing accommodating, collaborating and compromising conflict resolution techniques.

Members of DPP are strongly advised that litigation should be the last resort because it is not the mandate of the court to run the affairs of a political party However, the court has a discretion to be a legal arbitrator between the warring forces in DPP.

MBC Entertener Of The Year Awards: Akila wins Entertainer of Entertainers Award as Nanyoni, Zeze bags two awards each

Renowned film interpreter and actor, Akila, comedian Enifa Chiwaya and musician Zeze Kingston were the biggest winners at the Entertainers of the year award ceremony held on Saturday night at Bingu International Convention Center (BICC) in Lilongwe .

Akila won the Actor of the year award and the biggest award of the night, the ‘Entertainer of Entertainers award’ after getting more votes than all the other nominees.

Chiwaya popularly known in the theater circles as ‘Nanyoni’, won the Best female dramatist award and Best female stage dramatist award while Zeze who also performed at the event won the Artist of the year award whith his song ‘Kusangalala’ winning the song of the year award.

Miracle Chinga



Miracle Chinga received Female gospel artist of the year award and couldn’t hold back the tears as she stepped onto the podium to dedicated the award to her late mother, songbird Grace Chinga who answered God’s call some seven years ago.

Retired broadcaster, Pearson Chunga received the Director General’s (DG) award for his great contributions towards the media industry in the country and for being one of the pioneers of the Entertainers of the Year program.

Another recepient of the DG’s award was Agllyna Kumilonde who is one of the co-presenters of the Ankhoswe program on MBC.

The state broadcaster, Malawi Broadcasting Corporation (MBC) started the Entertainers of the Year Awards in 1975 but took a break in 2005 before being revived in this just ending year.

Man of the People KenZikhale Ng’oma on it again- donates to the elderly as part of new year initiative

One week after entertaining the youths of his Nkhata-Bay South Constituency on Christmas Day, Ken Zikhale Ng’oma has now focused on cheering the elderly on the first day of the new year.

On 1st January, 2024, Ken Zikhale Ng’oma who is a Member of Parliament for Nkhata-Bay South Constituency is set to donate various items to over 600 elderly people in his constituency as part of the new year celebrations.

Ng’oma whose name has always been a household among his constituents was again on song just a couple of days ago when he entertained the youths through *Ken Zikhale Ng’oma* football and netball bonanza that ended on the Christmas day at Kachere School ground in the area.



Speaking on the coming event aiming at donating to elderly, Ng’oma said; “We had bonanza finals on Christmas Day that mainly focused on our youths of Nkhata-Bay South, now its time for the elderly to celebrate with their legislator as we enter 2024 through the donation of various items I have prepared for them. At least 600 elderly are earmarked for the donation on 1st January 2024.”

Bullets crowned Castel Cup Champions after penalty shootout win over Silver Strikers

FCB Nyasa Big Bullets are on the verge of sealing a historic quadruple following their 4-2 win against Silver Strikers on penalty shootout to win the inaugural _Ibongetse_ Castel Challenge Cup on Saturday afternoon.

Substitute goalkeeper Clever Mkungula proved to be the hero of the day after saving two penalties from Chinsinsi Maonga and Nickson Mwase, during the post match penalties.

Yamikani Fodya, Hassan Kajoke, Clyde Senaji and
Precious Phiri scored their spot kicks for Bullets while the central bankers scored through Chimwemwe Idana and Maxwell Paipi.

The match which was played at the Bingu National Stadium ended 1-all in regulation time with goals from Atusaye Nyondo and Lanjesi Nkhoma for Silver and Bullets respectively.

The central bankers were the first to hit the back of the net through Nyondo’s powerful header, 8 minutes from kick-off, following a corner-kick beautifully taken by Duncan Nyoni.



The visitors had a chance to level the scores in the 13th minute after a beautiful exchange of passes but Lanjesi Nkhoma’s shot went over the crossbar.

After a couple of chances, Nkhoma equalised for Bullets in the 24th minute with a powerful shot after receiving a pass from Chawanagwa Gumbo.

Both sides continued to play a beautiful passing game in the first half but it was Bullets that created most chances than the homes side.

Five minutes before the end of the first half, Patrick Mwaungulu had a chance to put Bullets in the lead but his diflected shot was saved over the cross bar by Silver goalkeeper Pilirani Mapira.

In the second half, Bullets had to replace goalkeeper Richard Chimbamba with substitute Clever Mkungula after the former picked what looked like a serious injury in the 64th minute.

Silver then replaced Duncan Nyoni and Atusaye Nyondo with Zebron Kalima and George Chaomba.

Chaomba almost put his name on the scoresheet in the 70th minute but his close range shot was saved by Mkungula.

In the 80th minute, Bullets coach Kalisto Pasuwa introduced Ephraim Kondowe and Hassan Kajoke for Maxwell Phodo and Lanjesi Nkhoma.

He later introduced Nickson Nyasulu and Yamikani Fodya for Ernest Petro and Patrick Mwaungulu towards the end of the match while his counterpart Peter DeJong brought in Chinsinsi Maonga for Patrick Macheso.

Despite a number of efforts by both sides the match ended in a stalemate and had to be decided through penalty shootout when Bullets got the better of the Lilongwe giants.

After the match, Bullets’ 27-year-old Kenyan defender Clyde Senaji was voted man of the match.

This is the second loss for Silver Strikers this week alone as they were also knocked out of the Airtel Top 8 Cup by Mafco FC in a similar fashion .

The win for the People’s team means that the Ndirande outfit remain with a chance of sealing a quadruple if they can win the Airtel Top 8 Cup next weekend.

For winning the Castel Cup, Bullets have received K50 million from Castel while Silver have gone home with half of that amount.

First Lady Madam Chakwera cheers Mangochi elderly

First Lady Madam Monica Chakwera has urged people in the country to support the elderly by taking responsibility of their daily needs.

Madam Chakwera made the call at Chikoko Bay State Lodge when she hosted a luncheon to 120 elderly women around Chikoko Bay in Mangochi on Saturday.

Chakwera said the elderly are important people in society, hence the need to support and respect them.

‘‘This is Christmas season, and we are also going for the new year. As such, I thought I should celebrate with the elderly, as I am part and parcel of them.



‘‘Therefore, my advice to the younger generation is that while government is supporting the elderly through a number of programmes such as the Social Cash Transfer (SCT), they should consider the elderly as our assets for wisdom,” she said.

Chakwera emphasized that it is wrong for the community to consider the elderly as witches.

‘‘Let us avoid viewing the elderly as witches. They are just older people that God has blessed with longer life, a thing that we need to celebrate,’’ she said.

In her remarks, Special Advisor to the President on Women and Child Development, Dorothy Chirambo commended the first lady for inviting the elderly to the State Lodge.

Chirambo said this shows that the first couple has a heart for the elderly.
