PAC Rebukes Government for nepotism, corruption and demands Cabinet be reshuffled

The Public Affairs Committee (PAC) has criticized the Tonse Alliance administration for its failure to provide direction on the mitigation of economic hardships emanating from the impact of Covid-19 pandemic. PAC Chairperson Monsignor Dr. Patrick Thawale made the sentiments on Tuesday during a during a follow-up interface meeting Chakwera at Sanjika Palace in Blantyre.

The Committee has also rebuked President Dr. Lazarus Chakwera for presiding over a government that has allowed nepotism and selective justice to flourish.

“With due respect to explanations on the impact of Covid-19 pandemic and its implications on the economy Your Excellency, the public view seems to suggest that the administration lacks direction on the mitigation of economic hardship. We believe that in this area relevant Ministries that have a bearing on economic development ought to be aggressive in communicating to the public. It seems they have distanced themselves from their rightful role. Your Excellency may consider to packageproperly the information on economy to be imparted to the public, and your Cabinet Ministers ought to be in the forefront to defend and justify the economic status. This brings us to the next aspect we are following up,” said Thawale.

PAC chairperson also highlighted the issue of nepotism, stressing that questions continue to linger among well-meaning Malawians on how the President’s daughter’s posting to the Malawi Embassy in the United Kingdom and the appointment of son-in-law Sean Kampondeni, who doubles functions as Personal Assistant as well as Director of Communications, compounds the situation.

Thawale challenged that that “even if these officials have competences, this is Malawi, Your Excellency, the public will never trust you especially that those participating in this allegedly nepotism are in the Office of the Presidency.”

“Your moral standing becomes diluted,” he said.

Monsignor Dr. Patrick Thawale

While commending Chakwera for the positive strides registered in the drive against corruption by, among others, letting ACB and other enforcement agencies to arrest Cabinet ministers and the presidential aide, Thawale observed that “contradictions have emerged in the manner Chakwera’s administration has treated former Minister of Energy, Newton Kambala, and Minister of Lands, Hon. Kezzie Msukwa, on allegation of corruption as compared to the way you fired Minister of Labour, Hon. Ken Kandodo.”

He said recent developments on the fight against corruption have cast doubt on Chakwera’s political will to deal with corruption in Malawi.

“Media stories on the investigation by British and Malawi officials into businessman Zuneth Sattar appears greater in size which could undermine the integrity of the current administration. Your Excellency may consider avoiding the use of selective justice in treating cabinet Ministers – especially on issues you are able to make decisions,” he said.

PAC also demanded that President Chakwera should fire Secretary to the President and Cabinet (SPC), Zanga-Zanga Chikhosi, and other senior officials at the Ministry of Foreign Affairs and International Cooperation.

The Committee further recommended that the Tonse Alliance administration should “consider a review exercise which could guide the direction of Affordable Input Programme in terms of its sustainability or define its exit strategy in light of the budgetary constraints we face as a nation.”

It also advised Chakwera to reshuffle his Cabinet within three months.

“Your Excellency, understand us right. We would like to collaborate with you where we feel you are doing the right things. Secondly, in no way, we hate anybody in their personal capacity. Your Excellency, governments run on taxpayers money. Therefore players in democratic governance have every right to hold you accountable. Let us call spade a spade today, Your Excellency reshuffle the Cabinet and appoint competent Secretary to the President and Cabinet. Consider changes in the Ministry of Foreign Affairs as well, for there seems to be reputational challenges. In fact, the current Cabinet seems to be a spectator in their leadership style. A number of them lack gravitas and influence. For instance, this is the time those occupying rightful roles in economic arena should have been in the forefront of translating and explaining measures to mitigate economic hardship. Their silence is loud enough. We kindly call upon Your Excellency to consider reshuffling the Cabinet within three months. The public patience is running thin.

“Your Excellency, the current term of office is five years. Swift decision- making process is required. Indecisiveness on reshuffling the Cabinet, the revelations that your daughter assumed duties at the Embassy in UK, failure to make public Public Sector Systems Review Report submitted to you by the Vice President, and failure to fire Ministers allegedly involved in corruption as you acted on Hon. Ken Kandodo has led Malawians to brand your leadership as tainted with lies and corruption,” said Thawale.

“Your Excellency, although in the introductory part we appreciated your open door policy to dialogue with us and others, it should not be interpreted that PAC will continue holding dialogue without seeing actions being taken. We would opt for second level dialogue in form of All-Inclusive Stakeholders Conference with a developmental agenda should indecisiveness continue. The trust on Your Excellence has been eroded so fast as a result of your approach to decision making. In fact, you made mistakes on day one of appointing your Cabinet, coupled with failure to honour the pledge on reshuffling the Cabinet. Finally, Your Excellency, you are unique in the sense that you are the first leader in this position that requested us that we should be frank and honest with you in our dialogue exercise. Such a virtue is not common among leaders. And that is what exactly we have done today – to be frank with you,” he concluded.

Heavyweights Senegal failed to fire again and were fortunate not to concede a penalty in a 0-0 draw with unfancied Malawi. The Lions of Teranga still finished in top spot in Group B at the Africa Cup of Nations. The resilient and ever improving Malawi now awaits to see if they qualify to next round as best third placed team

Senegal won the group with five points, despite scoring only once in their three matches via a late Sadio Mane penalty against Zimbabwe in their opening game.

Malawi and Guinea both finished with four points but the latter took second spot on the head-to-head rule.

Senegal finished top of Group B at the Africa Cup of Nations despite being held to a 0-0 draw by Malawi.

Habib Diallo and Sadio Mane went close for Senegal, while Malawi had the award of a penalty overturned following a video assistant referee review.

The Flames thought they had a spot-kick in the 74th minute when left-back Gomezgani Chirwa went down under the challenge of Bouna Sarr.

But referee Blaise Yuven Ngwa reversed his decision after studying replays.

Malawi finish third in the table on four points and could yet qualify for the last 16 in Cameroon as one of four best-ranked third-placed sides.

Senegal, Nations Cup runners-up in 2019, only scored one goal in their three group matches – Mane’s 97th-minute winner against Zimbabwe in their opener.

The Teranga Lions will face a third-placed side from Group A, C or D in the last 16 on Tuesday, 25 January.

Senegal were back to full strength for the first time, with goalkeeper Edouard Mendy and captain Kalidou Koulibaly making their first appearances following bouts of Covid-19 and midfielder Idrissa Gana Gueye also returning after a positive test.

Yet Aliou Cisse’s side – among the pre-tournament favourites – were still lacking fluency and end product, and Malawi were the more threatening side in the first half after Mane lifted an early chance over the bar.

Koulibaly had to be alert to shut down Gabadinho Mhango twice, while the Flames forward had a free-kick deflected wide.

Meanwhile, Mendy, who was named Best Fifa men’s goalkeeper on Monday, had to help a Chirwa cross behind.

Senegal improved after the break as Diallo’s header and Mane’s curling free-kick from wide on the left were pushed over the bar by Malawi goalkeeper Charles Thomu.

Sarr put a diving header wide and, after Malawi’s penalty award was overturned, Senegal substitute Famara Diedhiou almost netted a sensational first-time volley having chested down a long ball.

Malawi tired as the game wore on, but could yet find themselves in the knockout stages for the first time in their history, having reached the Nations Cup for only the third time.

Techno Brain Sounds Warning on Upcoming Disruption to Malawi Passport System

One engineer under ‘Illegal’ House arrest

By Durrell Namasani

Techno Brain, the company at the centre of contact controversy with the Attorney General has warned Malawi citizens and stakeholders about a likely upcoming disruption to Malawi’s Passport System as a result of the company being prohibited by the Government from accessing infrastructure necessary to carry out scheduled maintenance procedures.

The Government of Malawi recently announced its cancellation of Techno Brain’s contract to provide e-passports and to undertake a comprehensive upgrade to the country’s entire passport issuance system on grounds that the company strongly disputes and is challenging through legal means.

Under the contract agreed by the Government of Malawi and Techno Brain in 2019, Techno Brain is responsible for creating the country’s new passport infrastructure, with plans to develop capacity to maintain and operate the system over time, including training and capacity building for over 125 DICS officers. However, these plans were cut short when the Government suddenly announced the cancellation of the contract in December 2021.

Techno Brain wishes to inform the public ahead of time that, as it is currently prohibited by the Government from accessing its infrastructure, it is regrettably unable to conduct scheduled maintenance procedures that are upcoming on 20 January 2022. Failure to perform these procedures is expected to result in disruption and potentially a full system shut down.

DICS officers posted outside the Techno Brain guesthouse in Lilongwe

In addition to jeopardising the passport issuance system by denying access to Techno Brain to critical infrastructure, one of Techno Brain’s technical engineers, Prakash Naidu, has been placed under illegal house arrest without charge since Saturday, 8 January 2022, after six officers from the Department of Immigration and Citizenship Services (DICS) arrived at the company guesthouse in Lilongwe. The DICS insists that Mr Naidu – an expatriate technical engineer who had remained in-country to ensure that the passport issuance system remained functional – will remain detained until Techno Brain agrees to hand over all infrastructure under the unilaterally-terminated contract.  A writ of habeas corpus challenging the detention as illegal has been filed with the High Court and the company is calling for his immediate release. Furthermore, concerns at the unlawful detention of Prakash Naidu have been raised with international human rights organisations.  The Attorney General’s justifications for this unlawful detention further exhibit a remarkable departure from basic rule of law norms.

Techno Brain maintains that the contract is the product of a competitive bidding process that followed all the relevant procurement regulations, and that its resumption would result in a win-win situation for all parties. The full implementation of the system was expected to deliver substantial efficiency gains, both for the Government of Malawi and for citizens that will no longer have to travel to Lilongwe or Blantyre to apply for a passport, as well as critical security benefits in terms of reducing incidents of forgery and identity theft.

Born in Africa, Techno Brain has a strong track record of operating in Malawi to date and employs a number of local staff to operate the system. It is proud of the strong role it has played delivering innovative and ground-breaking solutions in response to local needs and challenges across the region.
