DPP election nullification matter referred to Chief Justice for certification

High Court Judge Dingiswayo Madise on Monday July 5, 2021 refused to hear a State application to dismiss a case where the erstwhile ruling Democratic Progressive Party (DPP) is seeking the nullification of the results of the June 23, 2020 fresh presidential election.

Instead, the Judge has referred the matter to the Chief Justice for certification as a constitutional matter and to empanel a constitutional court to hear it.

Lawyer representing the DPP Charles Mhango prayed to the court to refuse the State application filed by Principal State Advocate Neverson Chisiza, on behalf of the Attorney General, asking the court to throw out the DPP lawsuit.

In his ruling, Justice Madise agreed with the DPP legal counsel but observed that since the matter raises serious constitutional issues, he had decided to refer it to the Chief Justice for certification as a constitutional matter.

The DPP recently moved the courts to nullify the results of the fresh presidential election, where the incumbent President Lazarus Chakwera was declared winner against DPP’s Peter Mutharika, arguing that the Malawi Electoral Commission (MEC) commissioners who managed the process and certified the results were illegal.

DPP’s line of argument follows a recent court ruling by Justice Kenyatta Nyirenda who said the appointment by former President Mutharika of four DPP nominated MEC commissioners, Arthur Nanthuru, Linda Kunje, Jean Mathanga and Steve Duwa.

The ruling Malawi Congress Party (MCP) recently sued the Presidency, under President Chakwera, for appointing more DPP MEC commissioners than the minimum number of three while the MCP only had two commissioners instead of three in contravention of the law.

In his ruling, Justice Nyirenda concurred with the MCP and ordered the reconstitution of the Malawi Electoral Commission by President Chakwera.

Apparently seriously aggrieved, the DPP filed a case against the Attorney General on behalf of the Office of the Republic of Malawi, praying to the court to annull the election results that the concerned commissioners had certified.

The DPP has cited, among its arguments, Section 75 (1) of Constitution, which provides that “There shall be an Electoral Commission which shall consist of a Chairman who shall be a Judge nominated in that behalf by the Judicial Service Commission and such other members, not being less than six, as may be appointed in accordance with an Act of Parliament”.

The DPP argues that it therefore follows that there was no legally instituted Electoral Commission when the fresh presidential election was held if Justice Nyirenda’s ruling is anything to go by and, therefore, President Chakwera was not duly elected.

Should the constitutional court rule in favour of the DPP, it may also restore Mutharika as President and Saulos Klaus Chilima as State Vice President.

2 Referees banned for demanding money from Team officials

National Football Referees Association NFRA on Saturday suspended Charles Bulazio and Arthur Chilimba for allegedly demanding money from team officials when they were assigned to officiate games between Arkas Flight vs Support Battallion and Civil Sporting vs Farming respectively.

This means that the two will not be allowed to officiate any game for 36 months.

According to a statement signed by NFRA’s General Secretary Chris Kalichero, the decision follows a disciplinary committee’s findings that the two were indeed involved in the malpractice during the FDH Cup matches.

A leaked WhatsApp conversation between Chilimba and Civil Sporting’s team manager Gabriel Chirwa revealed that Chilimba was demanding money from Chirwa for him to favour his team during the round of 32 encounter of the FDH Cup.

However Chirwa refused to give Chilimba the money and Civil went on to loose the game against Sable farming on post match penalties.

Comoros withdrawal forces change to COSAFA Cup fixtures

There has been a late change to the fixtures for the 2021 COSAFA Cup after Comoros were forced to pull out of the competition due their government’s restrictions around the COVID-19 pandemic.

According to cosafa.com Comoros was drawn in Group B alongside defending champions Zambia, Malawi, and
Madagascar, with their absence now leaving three teams remaining in the pool for the regional showpiece competition that will be staged in Nelson Mandela Bay from July 6-18.

It means Madagascar will take on Malawi in the opening game of the group on Wednesday (kick-off 15h00 SAST), with the Malagasy to then meet Zambia in the second game on July 10 (15h00).

The final pool match will be played on July 13 between Zambia and Malawi, which could be a potential decider for top spot.

Only the top team in each of the three groups will advance to the semifinals, along with the best-placed runner-up.

In order to level the playing field in the calculation for that best runner-up position, the results against the bottom sides in the four-team Groups A and C will be discarded. This is only to determine the best runner-up across the pool, the winners of each group will be decided using all games.

The other fixtures in the competition remain the same, with the action will get under way on Tuesday as Eswatini meet Lesotho in Group A (14h00). Later, hosts South Africa will play Botswana (17h00).

The first matches in Group C will be played on Thursday when six-time winners Zimbabwe tackle Mozambique (12h00) and west African guest nation Senegal face Namibia (15h00).

The group stages will end on July 14, with the semifinal matches to be played two days later. The competition final and third-place play-off will be staged on July 18.

Member of Parliament for Blantyre City South Noel Lipipa has revealed plans to open a driving and a tailoring school in his constituency.

According to the outspoken parliamentarian, the schools will help in empowering the youth and women in his constituency.

He said the driving school will offer lessons to Blantyre City South youths at a subsidized rate as a way of sustaining the driving school.



“I believe in changing lives in this Constituency through empowerment and not playing to the gallery. This initiative is one among many that I committed to my Constituents,” said Lipipa.

Recently, Lipipa was at loggerheads with musician cum-politician Fredokiss following the latter’s popularity in enhancing development activities in the constituency.

Soldier Lucius Banda ready to drop new music

Ailing veteran musician Lucius Banda has revealed plans to release a new music video this month end.

Making the announcement on his Facebook page, the musican-cum politician, said people should get ready for the new music video. He however could not reveal more details about the song.

He wrote; “Get ready for my video coming out on the 31st of this month….Venue to be announced later.”
