NGX Limited Struggles to Secure Offtaker for Malingunde Graphite Project

0

By Durell Namasani

NGX Limited is encountering significant hurdles in its search for a buyer for graphite from its Malingunde project in Malawi. The company has approached markets including China but has yet to secure an offtake agreement.

While the project’s graphite is a high-grade 97% carbon product, with spherical graphite commanding prices around $4,000 per ton, the company cites fluctuating market prices as a major impediment to finalizing a deal.

Further complicating the project’s progress are environmental and regulatory concerns. The Lilongwe Water Board has raised objections based on the project’s Environmental Impact Assessment, citing the mine’s proximity to critical water sources for the capital city. Simultaneously, the Malawi Mining Regulatory Authority has queried the ownership status of existing retention licenses, stating that confusing information requires clarification.

In response to these challenges, Minister of Mining Dr. Kenneth Zikhale Ng’oma has formally requested a detailed status report from NGX Limited CEO Peter Fox within 14 days. The report must outline the problems and propose concrete solutions.

NGX Limited has stated its commitment to overcoming these obstacles. The company plans to conduct a thorough market analysis to identify opportunities, address the water board’s environmental concerns with mitigation plans, and resolve the license ownership issues to ensure regulatory compliance.

CEO Peter Fox assured the minister that the company is prepared to advance the project and capitalize on the growing global demand for graphite once these bottlenecks are cleared.

A new survey released by Institute of Public Opinion and Research (IPOR) shows that President Lazarus McCarthy Chakwera of Malawi Congress Party is gaining ground since the opening of the official campaign two months ago.

The survey, whose results were released today in Blantyre, shows that comparatively with previous polls by the same pollster, Chakwera has gained five percentage points from 27 percent to above 31 percent.

Political experts say this trajectory indicates that President Chakwera is gaining ground due to his choice of running mate, vigorous campaigning and the way he packages his messages during interaction with communities.

Chakwera

“So far, he is the only candidate who has hit the ground running in a proper campaign mode. The rest are not doing enough to convince Malawians

The country’s most respected influencer, Stanley Onjezani Kenani, sees the upward inching of favourability of Chakwera as a key factor in determining the outcome of the election on September 16.

The survey has also revealed that President Chakwera is the most recognized presidential candidate in Malawi, with an awareness rate of 85 percent ahead of Peter Mutharika, who has a recognition rate of 79 percent.

Though Chakwera’s running mate, Vitumbiko Mumba is the second most recognized running mate behind the former Malawi Electoral Commission (MEC) chairperson, Jane Ansah, he comes out as the most favorable among voters.

“These factors from the survey show you that the Chakwera,Mumba ticket has the right momentum going into the final lap before elections,” says Blantyre-based political commentator Suzgo Malani.

The survey was conducted in the second week of August meaning people’s perceptions around candidates will have shifted even more by the time Malawi goes to the polls in two weeks time.

The ruling Malawi Congress Party (MCP) is leading in political media coverage ahead of this month’s elections, according to the August 2025 Broadcasting Monitoring Report (BMR)  by the Malawi Communications Regulatory Authority (MACRA).

State broadcaster Malawi Broadcasting Corporation (MBC) gave MCP the most visibility, with MBC Radio 1 allocating 82 percent of political coverage and MBC TV 62 percent, totaling over 2,900 minutes.

Independents and smaller parties also received notable airtime on MIJ FM (53%) and Timveni Radio (49%).

MACRA says most broadcasters had made efforts to balance their political coverage.

The High Court has denied bail to Annie Debre Mumba, who is serving a 53-year sentence for the murder of her husband, Peter Mumba, who was a professor of chemistry at Lilongwe of Agriculture and Natural Resources (LUANAR ).

In a ruling delivered on July 28, Justice Mzonde Mvula dismissed Mumba’s request for release pending appeal, stating that she was rightly convicted and no longer enjoys the presumption of innocence.

“The facts have been tried in full, any attempt to go out from prison on bail pending appeal is a mockery to the criminal justice system,” ruled Mvula .

Annie Mumba

Mumba was convicted in October 2024.

Her lawyers contended that the conviction was not supported beyond reasonable doubt and argued that the sentence was excessive.

However, the state maintained that she had failed to demonstrate ‘exceptional and unusual circumstances’ warranting bail.

Professor Mumba died of poison on April 25,2020.

High Court dismisses Chisale’s bid for constitutional Referral

The High Court in Lilongwe has dismissed an application by Norman Chisale seeking to have his criminal case referred to the Chief Justice for certification as a constitutional matter.

Chisale is answering charges of personation of a person named in a certificate contrary to Section 391 as read with Section 358 of the Penal Code, presenting false information to a public officer contrary to Section 122(a) of the Penal Code, and intimidation, contrary to Section 88(1)(a) of the Penal Code.

Chisale

The charges date back to 1996 and 2010.

He had argued that the 28-year delay in prosecuting the matter infringed on his constitutional right to a fair trial particularly the right to be tried within a reasonable time and to effectively challenge evidence.

In a ruling dated September 2, 2025, Justice Kondwani Banda observed that although the Courts Act does not expressly provide a procedure for magistrates to refer constitutional questions to the Chief Justice, the High Court retains inherent jurisdiction to ensure access to justice is not denied.

However, the judge held that Chisale’s application did not meet the threshold for certification as a constitutional matter.

The State, in its submissions, maintained that prosecution of the case only commenced in 2020 and argued that delays were partly caused by Chisale himself through numerous applications and appeals.

Reads part of the ruling:“Without going much further, it is upon considering the affidavits of both parties in support and against, and further upon hearing the parties, that I find the matter not fit to be referred to the Chief Justice by this court for certification as a constitutional matter. For the avoidance of doubt, this application is dismissed with costs.”

Speaking after the ruling, Chisale’s lawyer, Gilbert Khongongwa, said he is still consulting his client on the next course of action.
