Members of Parliament (MPs) have been commended for passing the long-awaited Data Protection Bill.

The legislators passed the Bill on Thursday, November 7, 2023,which seeks to provide for a comprehensive legal framework for the regulation of the processing and transfer of personal data, in compliance with internationally accepted principles of data protection.

The African Union Convention on Cyber Security and Personal Data Protection defines Personal Data as “information that relates to an identified or identifiable natural person by which that person can be identified, in particular by reference to an identification or to one or more factors specific to his/her physical, physiological, mental, economic, cultural or social identity”.

Matonga

In an interview, MISA Chairperson Golden Matonga says the world becomes more digitized and systematic and unsystematic collection of personal data online and offline becomes widespread, the passing of the Bill was long overdue.

“In the past decade or so, we have seen government agencies such as the National Registration Bureau (NRB) and private institutions such as telecommunication companies collecting and processing personal data without any legal framework safeguarding such data,” says Matonga.

He adds that MISA believes that the data protection law will promote responsible handling of personal data by government agencies, private institutions and individuals.

“The law will also be a big plus to section 21 of the Constitution of Malawi which guarantees the right to personal privacy.

“MISA Malawi therefore, would like to agree with the Media, Information and Communications and the Legal Affairs Committees of Parliament that the temporary housing of the Data Protection Authority by Malawi Communications Regulatory Authority (MACRA) should be for a period of not more than twelve months to ensure separation of powers by the respective Authorities, “he says.

One of the country’s renowned entrepreneurs, Kondwani Kachamba Ngwira, has advised new graduates to embrace entrepreneurship as an alternative to the prevailing job scarcity in the country.

Ngwira was speaking on Friday in Blantyre when 125 students were awarded with various certificates and diplomas in different areas of specialisation under the Soche Technical and Vocational College in Blantyre.

Ngwira stressed that it is not only paid jobs that matter in today’s livelihood, but that it is also important to sustain lives through entrepreneurship drive.

“Today’s livelihood is very competitive as we have a huge number of school leavers looking for jobs. The companies that we have cannot absorb the numbers. Therefore, Entrepreneurship is another way to sustain one’s life,” he said.

Ngwira observed that the economic shocks affecting the country are making it hard for the private sector to strive and employ school leavers, a situation which he said is contributing to the job scarcity in the country.

The entrepreneur further appealed to authorities to support the school leavers with seed capital and training so as to encourage them to venture into entrepreneurship industry.

Ngwira advised the graduates to be flag bearers wherever they go and endeavour to make a difference.

In his remarks, head of the construction department for the college, Paul Malunga said graduation is an affirmation of the collective mission to build capacity of the public and private sectors through training, research, consultancy and advisory services for enhanced performance.

“Our courses are designed in such a way that students can stand on their own to prosper in life,”said Malunga.

He added that the college has made it easier for more malawians to pursue studies and careers in various disciplines and that the course contents have been designed to suit the local environment making it easier for graduates to easily assimilate into the industries in Malawi.

The graduation ceremony also witnessed a number of well-performed graduates getting job contracts with the Project Innovations Centre(PIC) to boost their seed capital and venture into entrepreneurship thereafter.

In an effort to make sure that law students in the country are not meeting financial challenges in their studies, a law firm called Rits-Attorneys-At-Law says it will from next year start providing scholarships to these students.

Speaking on Friday during the finals of Rits Commercial Law Moot Court Competition, the firm’s head of business development, communications and marketing Sean Longwe said as a law firm, they do not feel good when they see law students dropping out of their studies because of financial challenges hence the decision to introduce scholarships initiative.

“Following the devaluation of the Malawi Kwacha by 44 percent, nothing is working in Malawi. We see school fees being raised by institutions something which is likely to increase number of drop outs. So as a law firm, we do not want law students experiencing such challenges in their studies hence our intervention to provide scholarships to them, “he said.

He indicated that the students to benefit from the scholarships will be picked from tertiary institutions that offer law programmes such as University of Malawi (UNIMA), Catholic University of Malawi ( UNIMA) and Malawi University of Business and Applied Sciences (MUBAS) which has recently introduced a law programme.

On his part, High Court Judge Justice Joseph Chigona praised the firm for introducing the Rits Commercial Moot Court Competition, saying it has provided a platform for University of Malawi law students to showcase their skills.

He said through the competition, the students are now demonstrating a good quality of advocacy in the field of law.

“You are doing a great job and we really appreciate the good work that you are doing at the law school in Zomba,” he said.

Alice Malunga and other three male students emerged as the winners of the competition.

They all went away with certificates.

Ritz Attorneys-At-Law, UNIMA’s Students Law Society (SLS) and UNIMA’s Faculty of Law signed a five-year partnership in 2021 with the desire to produce high quality lawyers who are well grounded in transactional, advisory and dispute settlement areas of commercial law.
