The High Court in Lilongwe has dismissed an application by lawyers representing Peter Mutharika’s former presidential aide, Norman Chisale, to have charges of accumulating unexplained wealth thrown out.

The case was heard before the High Court, which was sitting as the Financial Crimes Division.

Speaking after the court session, Director of Public Prosecutions (DPP) Masauko Chamkakala stated that the defence argued the alleged crimes were committed before the Financial Crimes Act was enacted.

Chisale

According to the defence, this meant that Chisale could not be prosecuted under the current law, and therefore, the case should be dismissed.

However, Chamkakala explained that the court ruled in favor of the prosecution.

He said the court found that other legal instruments in place at the time still criminalized the alleged offense.

As a result, the court determined that the charges against Chisale were valid and could proceed.

Chamkakala further stated that the prosecution had amended the charge sheet following concerns raised by the defence.

The amendments were made to provide clarity on the two charges Chisale is facing.

These charges include money laundering and possession of wealth that exceeds what can be legally declared.

Lawyers representing Chisale were not available to comment on the ruling.

Meanwhile, the case is set to continue on Tuesday this week.

During the next court session, the prosecution is expected to start parading witnesses to support their case.

This development marks a critical moment in the ongoing legal battle against Chisale, who has faced several legal challenges since his tenure as a presidential aide.

The outcome of this case could set a precedent for similar financial crime cases in the country.

Former President of Malawi and leader of the opposition Democratic Progressive Party (DPP), Professor Arthur Peter Mutharika, has issued a strong warning regarding the upcoming elections.

Mutharika has declared that if the elections scheduled for September 16, 2025, are manipulated or rigged, he and his party will not stand idly.

Mutharika

He emphasized that the DPP would take decisive action against those responsible for any electoral malpractice.

Speaking with conviction, Mutharika made it clear that his party would not tolerate any form of election fraud.

His warning comes at a time when political tensions in Malawi are rising ahead of the crucial polls.

The former president’s remarks reflect the growing concerns among opposition parties about the credibility of the electoral process.

Mutharika’s statement also signals that the DPP is preparing to closely monitor the elections to ensure transparency and fairness.

With memories of past contested elections still fresh, his warning is likely to fuel debate on the need for electoral reforms.

As Malawi heads toward the 2025 elections, all eyes will be on the Malawi Electoral Commission (MEC) to ensure a free and fair process.

Mutharika’s strong stance suggests that the opposition is ready to challenge any irregularities that may arise.

The political landscape is becoming increasingly charged as different parties position themselves for what is expected to be a highly competitive election.

Whether Mutharika’s warning will lead to changes in the electoral process remains to be seen.

What is certain, however, is that the DPP is determined to safeguard the integrity of the vote.
