Same sex marriages case adjourned to a later date

The High Court sitting as a Constitutional Court in Blanytre has on Tuesday adjourned the ‘Consential Same Sex’ case after parties involved wound-up their submissions.

Judge Joseph Chigona leading a panel of three judges in the case said the court will communicate the judgement day “in due course.”

The two-day session was meant for lawyers representing claimants, the respondents and Friends of the Court to submit their oral submissions.



In the case, claimants Wim Akster and Jana Gonani are being represented by Fostino Maere and Bob Chimkango respectively whilst lawyers Victor Jere and Thabo Chakaka-Nyirenda came as the state and Attorney General respectively.

Among others Friends of the Court in the case are Chikondi Chijozi, Pempho Likongwe, Innocentia Ottobar, Frank Mbeta and Bright Theu.

In the case, Wim Akster who is a dutch national and Jana Gonani (Malawian) are challenging the constituanality of laws that criminalize same sex relationships in Malawi.

Warrant of arrest against Humair Jussab over ‘hot car’

Chief Resident Magistrate Court in Blantyre has issued a warrant of arrest against businessman Humair Salim Mahomed Sidik Jussab over a car suspected to have been stolen from South Africa.

This is after Interpol a couple of weeks ago traced the car, VW Amarok, double cab, registration number BZ 1382, white, at a garage in Blantyre. He is suspected to be on the run.

Humair happens to be a young brother to businessman Mohamed Shabir Salim Jussab, who is also suspected to be on the run after another warrant of arrest was also issued against him earlier for alleged cyber harassment offences.

The warrant of arrest issued against Humair require investigators from Blantyre Police Station who applied for it to hunt the suspect and bring him before the court.

“This is to authorise and require you to enter into upon and arrest the said suspect, and if arrested, to take possession of the said suspect and produce the same forthwith before this court,” reads the warrant of arrest in part.

The warrant explains the offence is suspected to have occurred on December 15 2022 when the suspect brought the car into Malawi dishonestly.

Malawi Police Service (MPS) investigators, who formed part of the Interpol, carried out an operation in selected districts that included Blantyre and Mangochi, according to South West Region Police Headquarters spokesperson Beatrice Mikuwa.

The Interpol recovered four vehicles, including this Amarok VW registered in the name of Humair Jussab.

Humair’s elder brother, Shabir, apart from the cyber harassment offences, is also wanted by police for assault of his driver, and is also facing a K26 million claim for his client’s vehicle he failed to repair at his garage.

The K26 million claim was filed by Shafqat Kasam, demanding the refund which he said was value of his BMW convertible which he claimed RR Auto Service, Shabir’s garage in Blantyre, failed to repair it for over two years.

Kasam claimed in an interview his car, which he said was a runner and only had a sun roof problem which was not functioning, was not repaired until the garage was sold and he later heard that Shabir was on Interpol Red Alert and in Saudi Arabia.

On the case of the fired driver who told police he was assaulted, the 72-year-old ex-employee, Stainford Kalitsilira, told police his former boss assaulted him and verbally abused him on July 16 2021.

History made in Lilongwe City Centre , Nankhuni receive special blessings from MPs – Jiya and Msungama

For the first time history has been registered in series of eras. Politicians have always been known as difficult people to handle and they quarrel each and everytime they are together. Experience shows they do not trust each other. However this is not the case in the area of Lilongwe City Centre Constituency where there has been smooth transfer of power. This transition is not simple but able only with mature politicians.

Member of Parliament for Lilongwe City Centre, Alfred Jiya and Member of Parliament for Lilongwe City South East constituency, Ulemu Msungama and Shadow MP for the newly demarcated Lilongwe City Centre this afternoon met in order to do proper transition of power allowing Nankhuni to start mobilizing people ahead of the 2025 polls.

Speaking during this emotive function, MP Jiya described Nankhuni as a very strong and mature politician who came back to back with him.

Jiya said he is handing over a seasoned and and an accomplished politician to the people of Lilongwe City Centre.

Jiya made a strong appeal to the people of the newly demarcated constituency, to fully support Nankhuni.

“Nankhuni is a mature and dedicated politician, he is a man of vision and development conscious so its time to give him support, ” said Jiya.

Speaking also MP Ulemu Msungama commended Shadow MP Nankhuni for coming openly and declare his interest to contest during the forth coming polls.

Msungama called for unity among people of these constituencies in order to excell easily during the next polls.

Nankhuni has since commended Jiya and Ulemu Msungama for showing love in the way how they have handled this issue.

Export Credit Financing promotes trade and investment- Chithyola

Minister of Trade and Industry Simplex Chithyola-Banda says apart from promoting trade and investment Export Credit Financing (ECF) is an essential tool for boosting exports facilitation.

Speaking in Lilongwe on Monday when he opened a three-day ECF training Chithyola-Banda said the facility augers well with government’s vision of creating an inclusively wealthy and self-reliant export-led industrialized upper middle income country by 2063.

“Many countries including Malawi have rich natural resources that hold potential for increased export activity but often lack the financial resources or innovative financial instruments to fully exploit them to our economic advantage.

“For instance recently operationalized African Continent Free Trade Area (AfCFTA) Agreement opened up vast regional trade opportunities creating a unified market with over 1.2 billion people and a gross domestic product (GDP) of $2.5 trillion. However, for businesses within SADC Region to exploit such opportunities there is need for access to finance to bring goods and services to these markets,” he said.

Southern African Development Community Development Finance Cooperation and Resources (SADC-DFCR) Chief Executive Officer Stuart Kufeni said the region needs sound export credit finance functions that should enable export trade in a safe, value adding, and sustainable manner. But for this to materialise, we need to invest in skills and capacities to complement efforts of growing and diversifying export credit finance schemes and instruments that are available within the region and beyond.

In his remarks Export Development Fund (EDF) Managing Director Alfred Chanza said the training aims at building capacities, deepening knowledge, and sharing the best practices in the area of ECF.

“This practical and interactive course is designed for professionals seeking to build and improve knowledge of Export and Trade Credit insurance as well as widen understanding both of the range of products and their modus operandi,” he said.
