Malawians, Wake up! The Republic is being plundered, the Courts and the Executive are shielding the thieves

By Rick Dzida

Patriotic citizens of Malawi, how long will we sit back and watch our nation be asset-stripped by a cartel of corrupt elites who abuse the law against the public interest?

The recent suspension of the Parliamentary Joint Committee—orchestrated through a toxic cocktail of judicial overreach and political cowardice—is the ultimate declaration of war against the poor and the marginalized of this country.

We must rise, mobilize, and force the gates of justice open before our democracy is completely hollowed out.

The suspension of these critical investigations is a blatant constitutional violation that exposes how the three arms of government have collapsed into a mutual protection racket.

In a staggering display of arrogance, the judiciary granted an injunction to stop Parliament from investigating rotten government institutions—conveniently shielding themselves in the process.

This is the very same judiciary where “justice delayed is justice denied” is a daily reality for ordinary citizens, while wealthy suspects engage in blatant judge-shopping to buy immunity.

Speaker Suleman and President Mutharika

Following a private meeting between President Peter Mutharika and Speaker Sameer Suleman, the National Assembly abruptly halted all investigations. They folded like a deck of cards, choosing to submit to a corrupt court injunction without even attempting to fight back with a counter-injunction.

Rumours are rampant that Speaker Suleman completely succumbed to DPP pressure after being threatened with impeachment.

We cannot leave the defence of our constitution to compromised politicians. Every patriotic Malawian must legally join this battle by filing to enter the case as Amicus Curiae (Friends of the Court/National Assembly).

If the Speaker will not hire lawyers to fight this injunction, the citizens will. We must flood the registry with applications, asserting our constitutional right to oversight. This is no longer a political dispute; it is a civilian rescue operation of the legislature.

Where is the fire that once defined Malawi’s civic space? We demand that our leading Civil Society Organisations (CSOs) stop releasing lukewarm press statements and immediately launch strategic public interest litigation.

We urgently call upon the Human Rights Defenders Coalition (HRDC) to remobilize the masses and file immediate counter-actions.

Furthermore, the Centre for Human Rights and Rehabilitation (CHRR) and Youth and Society (YAS) must legally intervene and challenge this judicial coup.

With the Malawi Law Society (MLS) already intending to join the case, it must clean its own house and publicly condemn the practice of judge-shopping that is rotting the bench from within.

To our international partners, bilateral donors, and agencies like USAID, FCDO, and the European Union: do not fund a captured state, fund the accountability mechanisms.

The truth of the matter is that these parliamentary committees were not engaged in a political witch-hunt; they were acting on formal grievances and burning concerns written to the Speaker by an ordinary, concerned Malawian voter.

By shutting down this investigation, the state is crushing citizen-led accountability. We demand that the international community divert governance funds directly toward independent legal funds that enable civil society and public interest lawyers to fight this injunction to the Supreme Court.

Oh No!! We will not be silenced by a piece of paper signed by a compromised judge. To safeguard the public interest, we must execute the following actions immediately.

First, public interest lawyers must volunteer to represent citizen groups pro-bono to vacate the injunction.

Second, citizens must launch peaceful, sustained vigils at High Court registries nationwide demanding an end to systemic judge-shopping.

Now this is even more urgent. We must deliver a 48-hour public ultimatum to Speaker Sameer Suleman to file a counter-injunction, or face mass citizens’ protests demanding his resignation for failing to protect the independence of Parliament.

Regrettably, our country is being stolen in broad daylight under the guise of legal technicalities and compromised conformity to the ruling DPP . Stand up, fight back, and reclaim Malawi!
