The court battle that has been there between Malawi Communications Regulatory Authority (MACRA ) and Multi Choice Malawi has now come to an end following the approval of a proposal by Multichoice Malawi to have their DSt services subscription fees raised.

In a communication that we have seen addressed to the Multi Choice Malawi general manager, MACRA says now that the proposed tariffs have been submitted and considered by the Authority they expect DSTV services to resume in Malawi.

“Having considered and reviewed your submissions, the Authority approves both your June 2022 and July 2023 tariffs for implementation,” reads the letter in part.

In a separate interview, MACRA Director General Daudi Suleman said they have communicated to MultiChoice Malawi this morning on their approval on the tariff increase.

“Their reaction to the approval is interesting, we will wait for the court as they have also hinted and where necessary, undertake regulatory enforcement where some other aspects of the law and regulation are being breached by this unnecessary stand off my Multichoice Malawi,” he said.

But in an hour ago, MultiChoice Malawi released a statement saying that the resumption of their services will depend on the outcome of the court case between them and MACRA.

Multichoice Africa Holdings (MAH) withdrew the DStv services in Malawi after MACRA obtained a court injunction stopping it from raising subscription tariffs without adhering to the clearly spelt out legal provisions.

The Lilongwe Chief Resident Magistrate’s Court has declined the application made by Shepherd Bushiri and his wife, Mary, to have their extradition case in South Africa dismissed.

The Bushiris appeared in court on Monday to await the verdict on their request for the complete dismissal of South Africa’s extradition request.

However, Chief Resident Magistrate Madalitso Chimwaza ruled that the application was premature, given that no documentary evidence had yet been presented in court.

The court concurred with the Bushiris in their argument that the documents South African authorities sought to use as evidence had not been properly authenticated, and thus, might not be admissible.

Speaking with local media, Dzikondianthu Malunda, the State advocate, disclosed that the state intends to call a single witness, Sibongire Mzinyathi, who serves as the Director of Public Prosecutions for the Gauteng province in South Africa.

“The Court has ruled in our favour and we are happy. We hope the case will continue without disruptions and that it will be determined on merits,” said Malunda.

On the other hand, Wapona Kita, the lawyer representing the Bushiris, expressed satisfaction that the court had upheld the defense’s primary objection regarding the admissibility of the documents presented in court.

“We are very happy that the Magistrate has agreed with us on documents that were tendered in the court that they cannot be used as evidence because it is premature at this stage,” Kitta said.

Meanwhile, the court has adjourned the case until October 10, 2023, at which time the state is expected to present a witness.

The Bushiris, who returned to Malawi in November 2020, are wanted in South Africa to answer criminal charges bordering on fraud and money laundering.

In an effort to build strong relationships among its stakeholders, Malawi Communications Regulatory Authority (MACRA) organized sports activities on Saturday October 9, 2023 at Lilongwe golf club.

Participants were drawn from communication as well as the telecommunication sector to take part in games including basketball, football, netball, pool as well as bawo.

Speaking on behalf of MACRA, Mary Botomani, head of Human Resource and Administration said the reason behind the event was to bring the communication sector together for them to have different games and interact socially.

“We also help with health and safety and we hope with this interaction we are going to achieve that,” Botoman said.

One of the participants from Malawi Post Corporation, Zikubwerera Washon said events like these ones strengthen relationships within the communication sector as they all work towards achieving common goals.

“I commend these activities to be of great influence as in the course of doing this, people can easily avoid being attacked by different diseases, which will also help us to save the nation in the right way,” she said.
